The Department of Health (the Department) is bound by the Privacy and Data Protection Act 2014 (Vic) (the PDPA).
The Radiation Act 2005 (Vic) (the Radiation Act) provides that an application for an authorisation or approval under the Radiation Act (such as a use licence) must include certain prescribed information. For example, in the case of a use licence, the application must include details of the radiation sources or kinds of radiation sources the applicant will use, the purpose for which the radiation sources or kinds of radiation sources will be used and evidence of the applicant's qualifications (if any) that may be relevant to the proposed use.
If you are submitting a management licence application on behalf of another person, you will need to provide evidence that you have authorisation from that person to submit the application. You are responsible for ensuring that the applicant is aware of the matters set out in this privacy collection statement and agrees to submit the application on this basis.
If you choose to submit one or more applications, the Department will collect, use and disclose the personal information contained in your applications and notifications as permitted or required by the Radiation Act. This includes to assess your application for a licence or other type of approval, and to monitor your compliance with the Radiation Act. If you do not provide us with the requested information, the Department may not be able to assess your application or grant you the authorisation or approval that you have applied for.
It is an offence for you to use a radiation source unless you hold a current use licence that allows the use of that source. There are a number of serious offences related to matters such as the conduct of unlicensed radiation practices or the unlicensed use of a radiation source. The Department may disclose personal information it collects from you to various organisations and persons as permitted by law, in particular the Radiation Act. Please note that Section 136 of the Radiation Act allows the Department to disclose information that it collects under the Radiation Act or the Radiation Regulations 2007 (Vic) to certain persons and agencies (including the Health Complaints Commissioner, the Victorian Workcover Authority, the Commonwealth Health Insurance Commission and some practitioner registration boards) for the purpose of performing its statutory functions under the Radiation Act, or to assist other government bodies to perform their functions.
Information that you provide through our online application portal will be stored in Victoria. We also use IT infrastructure that includes servers in other States and Territories within Australia, and your data may also be stored on those servers.
